Ticket Terms and Conditions

These terms and conditions ("Terms") govern the purchase and use of a ticket for Long Horizon (the "Event"), organised by Cord Technologies, Inc. registered in Delaware at 251 Little Falls Drive, City of Wilmington, DE 19808, United States of America ("Encord", "we", "us" or "our").

By purchasing a ticket, you ("you", "your" or "Attendee") accept and agree to be bound by these Terms. If you do not agree to these Terms, you must not purchase a ticket. These Terms bind each individual who purchases or uses a ticket to attend the Event. In addition to these Terms, we also publish a Privacy Policy that describes how we process, collect, use, and protect your information. Our Privacy Policy is deemed incorporated into this Agreement.

Where you are required to tick a box confirming your acceptance of these Terms and our Privacy Policy as part of the checkout process, doing so, together with completing your purchase, constitutes your electronic acceptance of these Terms. This has the same legal effect as a signature, to the extent permitted by applicable law.

1. 1. Tickets

   1. 1.1Tickets are made available for purchase via Ticket Tailor and are subject to availability.
   2. 1.2A ticket confirmation email is a receipt of purchase, not a guarantee of admission. Admission is subject to your compliance with these Terms and any applicable venue rules.
   3. 1.3Tickets are issued to a named individual and are non-transferable, except as permitted under clause 4.1.
   4. 1.4Encord may refuse admission to, or remove from the Event, any person who fails to comply with these Terms, the venue's rules, or the code of conduct at clause 7.
   5. 1.5Lost, stolen or destroyed tickets will not be replaced or refunded, except at Encord's sole discretion.
   6. 1.6Each ticket is uniquely coded and may only be used once for admission. Encord may deny entry where duplicate or previously used tickets are presented.
   7. 1.7Tickets may not be resold, or offered for resale, for profit, nor advertised for resale on any secondary ticketing site or platform, without Encord's prior written consent. Encord may cancel, without refund, any ticket found to have been resold in breach of this clause.

2. 2. Price and Payment

   1. 2.1Ticket prices are as displayed in USD at the time of purchase and are inclusive of any applicable taxes, unless stated otherwise.
   2. 2.2Tickets are sold via Ticket Tailor, the Event's ticketing platform. Payments are processed by Stripe, Inc. and its affiliates (“Stripe”), a third-party payment processor operating on Ticket Tailor's behalf. By completing a purchase, you also agree to Ticket Tailor's and Stripe's respective terms of service and privacy policies, available at tickettailor.com and stripe.com respectively.
   3. 2.3Encord does not store, and does not have access to, your full payment card details. Payment data is collected and processed directly by Stripe.
   4. 2.4Payment must be made in full at the time of booking. Your purchase is not confirmed, and no ticket is issued, until payment has been successfully processed by Stripe.

3. 3. Cancellations and Refunds by Encord

   1. 3.1If the Event is rescheduled or cancelled, Encord will notify ticket holders using the contact details provided at purchase.
   2. 3.2Where the Event is rescheduled to a new date, tickets remain valid for the rescheduled date. An Attendee unable to attend the rescheduled date may transfer their ticket to another individual in accordance with clause 4.1.
   3. 3.3Where the Event is cancelled entirely, with no rescheduled date, the ticket price will be refunded in full to the original payment method.
   4. 3.4Refunds under clause 3.3 will be processed within a reasonable period following the cancellation. Encord is not liable for any other costs incurred by an Attendee in connection with the Event, including travel or accommodation costs, except where required by law.

4. 4. Cancellations by Attendees

   1. 4.1Tickets are non-refundable. Where an Attendee is unable to attend the Event, the ticket may instead be transferred to another individual, in accordance with clause 1.3. Transfer requests must be made in writing to jack.henchy@encord.com up to 7 days before the Event.
   2. 4.2Tickets are sold to purchasers acting in the course of their trade, business, or profession, and not as a consumer.

5. 5. Changes to the Event

   1. 5.1Encord reserves the right to make reasonable changes to the Event, including to its date, time, venue, format (in-person, virtual or hybrid), content, or speakers, where reasonably necessary.
   2. 5.2Where such changes are material, Encord will use reasonable efforts to notify Attendees in advance. Minor changes do not entitle an Attendee to a refund or compensation.

6. 6. Force Majeure

   1. 6.1Encord will not be liable for any failure or delay in performing its obligations under these Terms, including cancellation or postponement of the Event, arising from circumstances beyond its reasonable control, including acts of God, war, terrorism, epidemic or pandemic, governmental action or restriction, strike, or failure of venue or public infrastructure.

7. 7. Code of Conduct

   1. 7.1Attendees must behave in a professional and respectful manner towards other attendees, speakers, staff, and venue personnel at all times.
   2. 7.2Encord operates a zero-tolerance policy towards harassment, discrimination, or abusive behaviour of any kind. Encord may remove any Attendee from the Event without refund for breach of this clause.

8. 8. Health and Safety

   1. 8.1Attendees must comply with all health and safety instructions issued by Encord or the venue, including any public health measures in force at the time of the Event.
   2. 8.2Attendees attend the Event at their own risk. Encord is not liable for any injury, loss or damage suffered by an Attendee, except to the extent caused by the negligence of Encord or its employees or agents.

9. 9. Photography, Filming and Recording

   1. 9.1The Event may be photographed, filmed, live-streamed, or recorded by Encord or its appointed suppliers.
   2. 9.2By attending, you consent to being photographed, filmed or recorded, and to Encord's use of such content for marketing, promotional, and archival purposes, in accordance with our Privacy Policy.
   3. 9.3Attendees may not record or livestream any part of the Event without Encord's prior written consent.

10. 10. Intellectual Property

    1. 10.1All content presented at the Event, including presentations, slides, and recordings, remains the intellectual property of Encord or the relevant presenting party.
    2. 10.2Attendees may not reproduce, distribute, or commercially exploit any Event content without prior written consent from Encord or the relevant rights holder.

11. 11. Data Protection

    1. 11.1Encord will process personal data collected in connection with ticket sales and Event attendance in accordance with its Privacy Policy.
    2. 11.2By purchasing a ticket, you acknowledge that your personal data may be shared with Ticket Tailor and Stripe for ticketing and payment processing purposes, and with venue or Event partners strictly as necessary to deliver the Event.
    3. 11.3Ticket Tailor processes personal data collected via its platform under its own privacy policy, independently of Encord. Attendees should review Ticket Tailor's privacy policy in addition to these Terms.

12. 12. Limitation of Liability

    1. 12.1To the maximum extent permitted by law, Encord's total liability to an Attendee arising out of or in connection with the Event or these Terms shall not exceed the price paid for the relevant ticket.
    2. 12.2Encord shall not be liable for any indirect, special or consequential loss, including loss of profit, business, or opportunity.
    3. 12.3Nothing in these Terms excludes or limits Encord's liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded or limited under applicable law.

13. 13. General

    1. 13.1Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and Encord regarding your purchase and attendance at the Event.
    2. 13.2Severability: if any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
    3. 13.3Assignment: you may not assign or transfer your rights under these Terms without Encord's prior written consent. Encord may assign its rights and obligations under these Terms at its discretion.
    4. 13.4No waiver: a failure by Encord to enforce any provision of these Terms is not a waiver of that provision.
    5. 13.5Governing law and jurisdiction: these Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. The state and federal courts located in San Francisco, California have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
    6. 13.6Amendments: Encord reserves the right to amend these Terms at any time. The version of these Terms in effect at the time of your ticket purchase will apply to you.
